Résumé
The expression "insurmountable circumstance" is regularly found in criminal proceedings. But this notion is largely unknown and is given little importance. Neither the judge nor the legislator gives a definition. However, it has a very real interest that should be highlighted. This study then attempts to expose its role in positive law and to give a definition. It is an autonomous derogating legal rule which takes the form of circumstances not attributable to the person relying on it, which are insurmountable for him and which is applicable whenever a procedural rule is sanctioned by the nullity of the procedure or by the loss of a right, unless the person concerned has another way of anticipating or circumventing the obstacle, and provided that the latter is precisely demonstrated both by the party alleging it and by the judge who takes it into account.
On trouve régulièrement dans la procédure pénale l’expression « circonstance insurmontable ». Mais cette notion est largement méconnue et on ne lui prête que peu d’importance. Ni le juge ni le législateur n’en donnent de définition. Elle présente pourtant un intérêt bien réel qu’il convient de mettre en lumière. Cette étude tente alors d’exposer son rôle dans le droit positif et d’en donner une définition. Il s’agit d’une norme juridique dérogatoire autonome qui se matérialise par des circonstances non imputables à celui qui s’en prévaut, qui revêtent pour lui un caractère insurmontable et qui est applicable à chaque fois qu’une règle procédurale est sanctionnée par la nullité de la procédure ou par la perte d’un droit, à moins que la personne concernée ne dispose d’un autre moyen pour anticiper ou contourner l’obstacle, et à condition que ce dernier soit précisément démontré tant par la partie qui l’allègue que par le juge qui en tient compte
