Le contrôle de l'Etat sur les collectivités territoriales au Mali

Abstract : Despite the number of laws determining the conditions for the free administration of local authorities in Mali, state control over the acts and organs of these local authorities clearly appears to be a central instrument in the theory of decentralization, thus verifying the analysis according to which the scope of a decentralization policy cannot be assessed outside control. This issue is confirmed by the examination of the principles laid down in this area by Malian legislators from 1993 to 2017 as well as by taking into account the role of administrative and financial jurisdictions. The study of legislative and jurisprudential solutions then leads to examine the current characteristics of State control over local authorities and to assess, as concretely as possible, the actual operating rules provided for by Laws No. 2017-051, 052 and 053 of October 02, 2017.
