Shared between the universal and the national, the Constitution of 27 January 2014 is the last expression of Tunisian constitutionalism. Inscribed in the Arab-Muslim era, this constitutionalism questions the impact of Islam on the traditional components of constitutionalism. Studying the fate and rise of constitutionalism in Tunisia, the comparatist seeks to know how Tunisia adapts its constitutional identity with the foundations of constitutionalism. In apprehending the Tunisian constitutional reality, the comparatist points out the tension between global constitutional standards and identitarian and national specificietes. Nevertheless, the Tunisian singularity appears in contrast with similar Arab and Muslim experiences such as Egypt and Morocco.
Partagée entre l’universel et le national, la Constitution du 27 janvier 2014 est la dernière expression du constitutionnalisme tunisien. Inscrit dans l’ère arabo-musulmane, ce constitutionnalisme interroge l’impact de l’Islam sur les composantes traditionnelles du constitutionnalisme. En étudiant le sort et l’essor du constitutionnalisme en Tunisie, le comparatiste cherche à savoir comment la Tunisie aménage son identité constitutionnelle avec les fondements du constitutionnalisme. En appréhendant la réalité constitutionnelle tunisienne, le comparatiste relève la tension entre les standards constitutionnels globaux et les spécificités identitaires nationales. Malgré cela, la singularité du cas tunisien apparaît au contact d’expériences arabes et musulmanes similaires à l’instar de l’Egypte et du Maroc.
