Les piliers social et culturel du développement durable en droit

Abstract : The analysis of the social and cultural pillars of sustainable development in law referred to in this work is a contribution to the study of sustainable development. The aim is the promotion, integration and effectiveness of sustainable development in public policy. It can be seen that economics and theenvironment can take advantage of these three elements. The social and cultural recognition in sustainable development has experienced some scientific setbacks. The social and cultural aspects have been proven since the ICESCR. Numerous regional texts recognize the legal nature and theimpact of social as well as culture aspects in the economy and the environment. The ICESCR is evidence of the unity of sources between economic, social and cultural pillars. It has contributed to the (voluntary or involuntary) attachment between its various elements. Unfortunately, the consequencesof this connection have led either to the illegibility of the social aspects or to the total forgetfulness of the cultural aspects in national, regional and international public policies. Social and cultural issues enhance sustainable development and integrate it into our societies through its acceptance by all international, regional and national actors who have a major role to play in the feasibility of sustainable development in our territories. It is in this condition of permanent agreement that sustainable development focuses on the respect of fundamental rights by highlighting certain indispensable devices with respect to our society. This will include ethics, social equity, social justice and other instruments such as CSR codes of conduct and SRI. At the same time, cultural diversity is equally taken into account. The majority of these elements are based on Soft Law. As such, there is a real reconciliation between culture and sustainable development. Ultimately, it is up to the judge to give full meaning to sustainable development and to stabilize the strength between these different components. This mission is all the more important because it shows that sustainable development can no longer be considered as a principle but rather as a right.
