La Dévolution en Grande-Bretagne: contribution à la réflexion sur l'autonomie institutionnelle

Abstract : Devolution, constitutional reform initiated in 1997 by the Blair government, shocked the British unitary model. Indeed, this decentralization policy, including the delegation of legislative power entrusted to the component nations of Britain, introduced elements federalizing the state structure and threatening the institutional identity of the Anglo-British state. This differentiation and diversification statutory territorial entities, Scottish and Welsh, then pose the question of maintaining state unity, its abandonment, or redefine it. If devolution seems to respond to a crisis of state legitimacy, it is also indicative of a transformation of state structures and relations of it with civil society. A new definition of the system of government, integrating the concept of "governance", allows the state to offload some of its responsibilities to entrust them to new partners or to exercise them in cooperation with the private sphere. Devolution is therefore both a factor in the modernization of the British constitution and evolution of the state. Devolution should not however be isolated from the overall reform to modernize the constitution as it can be studied without comparison with other European models. The affirmation of the subsidiarity at European level, as a principle governing the relations of state and local governments, suggesting a common regional process and encourégé. If devolution is primarily a process allowing to consider other developments, including the Scottish nationalists win elections in May 2007, its evolution, its viability or spend its actors and their ability to adapt.
