L'origine des marchandises : un élément controversé des échanges commerciaux internationaux

Abstract : The link between the goods and the territories has never been so important as today. The determination of the origin of the goods is still a major question of the international trade for three well known reasons. In the first place, the industrial revolution entailed the international specialization, which means that most of the goods contain elements of different origins - now, the question is to attribute to these goods a unique origin. Secondly, the development of the protectionist techniques and commercial defense considerably strengthened the interest linked to the allocation of the origin - the efficiency of these techniques depending strictly on this very allocation. Thirdly, the proliferation of the preferential regimes increased the importance of the determination of the origin, every agreement or autonomous system (SPG, for example) fixing a particular notion of the origin. Nowadays, the notion of origin is a very complex concept and doesn't fit properly to international trade. Declaring the origin becomes a high-risk operation. As a result, the exporter can be confronted with several definitions of the origin according to the country where he gets ready to export. It is necessary to always take this into account, because the host country is the one that defines the conditions of allocating origin. However, the interests in conflict are too divergent for us to build a notion of origin universally admitted. In these conditions, it is very difficult to bring remedies to the problem of the origin. Nevertheless, we tried to present some tracks to foster a general reflection.
