Réglementation et choix organisationnel. Le cas du transport maritime et intermodal en Europe et aux Etats-Unis

Abstract : To increase rail freight share the European Commission liberalised railways and invested in intermodal transport. However, rail freight share dropped from 21% to 7% from 1970 to 2002.
This dissertation brings new elements to develop European intermodality. For this purpose, a case study based on 29 interviews and on the contracts used to frame horizontal maritime transactions in the transatlantic traffic, has been carried.
This dissertation defends two hypotheses. First, it explains the weak share of intermodal transport in Europe by the inefficiency of the governance that frame intermodal operators and ocean carriers' transactions. This proposition is founded on Transaction Costs Theory according to which the governance structure must be aligned on the transactions attributes to reach efficiency, i.e. the minimisation of transaction and production costs (Williamson, 1985).
Secondly, it proposes that the institutional environment is a constraint to develop intermodal transport when offered by ocean carriers. This proposition is based on the theoretical contributions of North (1990) and Williamson (1993), according to which the rules of the game influence agents' organisational choice.
The results of this dissertation identify the vertical and horizontal cooperation as the governance that can overcome the technical problems of intermodal transport and protect the investments necessary to develop this service in Europe. The American case is helpful since railways decline in the 80's was surmounted through regulatory and organisational changes.
