Autorité indépendante et gouvernement : la régulation bicéphale du marché français des télécommunications

Abstract : The thesis concerns the distribution of regulatory powers in the process of telecommunications liberalization. In a first part, we define the distribution of competence between independent and political regulators by studying the European directives in an institutional point of view. We show then that the French law liberalising the sector has partially taken into account the European recommendations since the government intervenes in the regulatory process whereas the State is still shareholder of the incumbent. In the second part, we highlight, in a theoretical and empirical way, the private objectives of these two regulators. By supporting us on the assumptions of governmental behaviour developed by the public choice school, we show that the decisions of the political authority are influenced by the former monopoly. Then, by studying the instruments of capture proposed by economic literature, we show that the independent regulatory agency is influenced by the new private operators. In the third part, we examine the influence of these private objectives on the regulatory process. We show that the sole intervention of a political regulator does not allow the competition to develop, to the detriment of consumers and new entrants. At the same time, the sole intervention of an independent authority generates an excessively competitive market structure, to the detriment of consumers and the incumbent. We show then that the best institutional organization consists in distributing regulatory competence between two regulators pursuing diametrically opposite objectives.
