Abstract : This thesis deals with the socio-spacial relationship between private and public in consumption spaces of contemporary cities, taking on an interdisciplinary perspective and focusing on the legal approach. At a time when the paradigm of "urban privatisation" grows ever stronger, publicization mechanisms of these private spaces are analysed by studying one object in particular. Recreational shopping malls are the result of a strategy aiming to integrate leisure and retail activities, in response to a post-Fordist consumption context; and their growth leads one to consider them as the offspring of shopping centers, particularly in France. The France-Mexico comparison demonstrates that leisure was indeed integrated very early on, in various forms, throughout shopping centers in Mexico City, and that the recreational function of retail activities has always been attributed a greater value. In addition, the publicity of recreational shopping malls is a reflection of the city's social divisions, varied according to different contexts.
